Aircraft Operator Holding Account

Since 1^st January 2012, aviation activities are subject to Directive 2008/101/EC of the European Parliament and of the Council, of 19 November, amending Directive 2003/87/EC of the European Parliament and of the Council, of 13 October 2003 and Law 1/2005, of 9 March.

Any aircraft operator falling within the scope of application of Law 1/2005, of 9 March and which has an approved Monitoring Plan, is obliged to have a credit account in the name of the aircraft operator in the Union Registry and comply with the obligation detailed in section 2 of Article 27 of the aforementioned Law, concerning the surrender of emission allowances.

7. Also, due to the upcoming new regulation (on 10 September 2023 the COMMISSION DELEGATED REGULATION (EU) 2023/1642 of 14 June 2023 amending Delegated Regulation (EU) 2019/1122 as regards the modernisation of the functioning of the Union Registry) account holders that are part of a group shall provide a document clearly identifying the structure of the group. This document must be notarized and show the business group structure. You can use our template. The date of the certification or legalisation shall not be more than three months prior to the date of application.
