Amends of the the Commision Delegated Regulation (EU) 2023/1642 of 14th june

The following is a summary of the main changes brought about by this amendment for Authorised Representatives of account holders in the Union Registry:

  • Threshold above transactions – Article 23

The central administrator may set a threshold above which transactions can only be performed to accounts that appear in the trusted account list. This threshold will apply from 10 September 2023 and has been initially set by the European Commission at 2 million EUA's per transaction (including General allowances(phase 3 and 4), aviation allowances and Swiss allowances), from which it is necessary that the account receiving the transaction is registered in the list of trusted accounts of the sending account.

In the same way, account representatives may set thresholds for transactions for their own accounts. Such limits must be approved by a second account representative. This new option of the EU Registry gives the possibility to set voluntary thresholds, which can be daily, weekly, or monthly. The setting of these voluntary thresholds does not imply the disappearance of the application of the threshold of 2 million EUAs set by the European Commission.

Authorised Representatives will be able to access these thresholds through the "Transaction thresholds” in the coming days we will publish a manual explaining how to set these account thresholds.   • New requirement: indicate transfers between account holders that belong to the same group – Article 55.f

Upon initiation of a transfer, the authorised representative shall indicate, if wanted, whether the transfer has been executed between account holders that belong to the same group.

  • New requirement for holding accounts – Annex IV.5.f

Account holders that are part of a group shall provide a document clearly identifying the structure of the group. This document must be notarized and show the business group structure.

This amendment brings with it other changes related to the integration of the EU Transaction Log into the EU Registry's own infrastructure, as well as regulatory aspects of cooperation between the Registry and European audit institutions regarding to the Registry's information, for which we recommend that you read the amended text.

Security protocol TLS 1.2

New technical requirement to use the Union Registry.

From 15th October access to the Union Registry will be restricted to web browsers supporting version 1.2 of the Transport Layer Security (TLS) protocol. After this a connection to the Union Registry with less secure protocols will not be accepted. Most of the recent browsers (Chrome, Firefox, Internet Explorer and Safari) support TLS v1.2 by default but we strongly advise users to check their compatibility with TLS 1.2 well in advance of 15th October.
